How to get a Will in the UK

What is a will?

A Will is a legal document in which the testator describes the distribution of his/her assets, after his/her death. In the will, the testator must specify the beneficiaries, who can inherit the property of the testator after his/her death.

The assets mentioned in the will are legally termed as Estate, and the estate includes house, savings in the bank as well as bonds, insurance, investments like stocks and shares, jewellery, furniture, etc.

What makes a will legally valid?

  1. The Will should be in written form, and has to be attested by the testator and two witnesses. The witness should not be the beneficiaries of the will.
  2. The testator and witnesses should be aged above 18 and should be of sound mind.
  3. The testator must have the intention to make such will, and such an intention should be voluntary, without any coercion or undue influence.

How to get a will in the UK

There are many ways to get a will done in the United Kingdom, here are 4:

Lawyers: Approaching a lawyer for making a will is one of the most common ways of getting a will in the United Kingdom. This is because the lawyer takes care that the will is legally valid and also makes sure that there are no mistakes or misinformation in the will.

Generally, it is advisable to approach a lawyer while drafting the will with respect to distributing property to someone other than a life partner or when the testator owns property outside of the United Kingdom.

It is also important to instruct a lawyer when the testator is not a permanent resident of the United Kingdom.

At CP Law Associates we provide a will writing service that can be tailored to your needs. We can store your will and make any amendments to your will for you. We can also help you to make a lasting power of attorney to give someone you trust the authority to make decisions on your behalf.

Professional Will Writers: These are professionals who are registered under the Institute of Professional Will Writers, but not the solicitors. These professionals were regulated by the code of ethics of the institution. It is advisable that before consulting the professional, make sure that that the professional was registered under the institute.

Charities: In the United Kingdom many Non-Governmental Organizations offer free will drafting services as a part of the charity. These organizations generally conduct campaigns in specific areas.

Making your own will: Everyone can make their own will but make sure that all the legal requirements are met properly to make the will valid. Since the will is a legal document it is advisable to take help from any of them mentioned above instead of making one’s own will.
